A solicitation calling for Johnson Sakaja’s disqualification from the governor’s election due to the trustability of his academic papers was denied by the High Court.
On Tuesday, July 12, 2022, Justice Antony Mrima dismissed a Dennis Gakuu appeal that questioned the legality of Sakaja’s degree.
“ The court concludes that Sakaja’s concurrence to run for the Nairobi governor’s seat by IEBC was correct. The solicitation is latterly dismissed with costs since it was unprofitable “ The court decided.
Last Monday, Justice Mrima permitted the IEBC to continue publishing the ballots while the action was still pending.
Because of the disagreement girding his degree instrument, Sakaja had requested High Court orders to help the IEBC from deleting his name from the list of campaigners.“ The order shall not be issued at this time given that procedures have formerly been made for an accelerated hail for this matter. ” The Judge said.
Despite Sakaja’s claims that his degree from Team University in Uganda was legitimately earned, the Commission for University Education( CUE) ruled that the degree isn’t honored after literacy of its validity.
Despite the fermentation girding Sakaja’s degree, the IEBC controversies Tribunal rejected a solicitation that questioned her academic credentials, specifically the degree needed.
The bench determined that the IEBC wasn’t needed to look into the validity of campaigners ’ academic credentials and that similar inquiries should rather be handled by the legal system and felonious investigative associations.
“ The returning officer and his agents warrant the legal authority and necessary governance to authenticate a degree instrument outside of what’s allowed under Regulation 47 of the choices General Regulation( 2012).
“ Beyond what’s permitted by Regulation 47, the Alternate Replier lacks the authority to look into or else corroborate the validity of academic credentials submitted to it by political party campaigners. Our final decision is to hereby dismiss this complaint without incurring any freights “ Tribunal took notice.
The legality of Sakaja’s academic credentials had come under scrutiny, generating debate on both sides of the aisle.
